Update:  John D. Bawell has been acquitted on the most serious charges  related to the September 2016 crash in Paradise Township.

A couple were seriously injured after a drunken driver struck their motorcycle Monday in Paradise Township, police said.

John David Bawell, 38, of 1437 White Oak Road, Paradise, was charged with aggravated assault with a vehicle while DUI, accident involving death or personal injury and possession of a small amount of marijuana. He is being held at Lancaster County Prison on $100,000 bail.

David Sparks and his wife, Tammy, both 52, were taken to Lancaster General Hospital, state police said. David Sparks suffered a broken leg, broken ribs and a concussion. Tammy Sparks suffered broken ribs and a concussion.

Bawell, who fled the scene of the collision before returning 15 minutes later, was not injured, police said.

Bawell’s pickup truck struck the motorcycle shortly after 11:30 a.m. at Route 896 and White Oak Road when he failed to yield the right of way, police said in a complaint. Bawell did not have proper emissions testing, vehicle registration or automobile insurance, and he refused a blood test after failing sobriety tests.

A preliminary hearing is set before District Judge Raymond S. Sheller at 2 p.m. Sept. 20.
