Neighbors of the Joseph Kauffman property on Bell Road attended Colerain Township Supervisors meetings several times last year to complain about loud noise from the shed-construction business, including start times that were earlier and later than the hours of operation granted to Kauffman when the zoning hearing board gave its approval to the business about eight years ago.
Now Kauffman has requested a change to the conditions that go along with his variance approval to extend his approved hours of operation. A zoning hearing board meeting will be held at 7 p.m. Feb. 8 at the township building to consider the request.
Supervisors do not take part in the decisions of the zoning hearing board, but they sometimes give their opinion or offer evidence during testimony at hearings. In its discussion at a Monday meeting, the board did not feel it wanted to take a stand.
"I don't have a feeling one way or the other because when I've been there, I have not found a whole lot objectionable," supervisor Walter Todd said.
Conditions on the original approval allowed work hours of 8 a.m. to 5 p.m., but later, a change was made to allow work to start at 7 a.m.
Because there could be a legal challenge against another change to the zoning conditions, Todd suggested supervisors do not get involved.
"I wouldn't want to get into something that we would lose if there was to be a legal challenge," he said.
Before the meeting ended, the supervisors briefly looked at a request for funding from the Lancaster County Drug Task Force. Based on $1 per resident as reported on the 2010 census, the agency requested $3,635 from the township.
Supervisors have not budgeted a contribution for 2012, and, for the moment, are not going to respond.
"What we were doing, at least years ago, was giving the fine money" (collected by the courts and sent to the municipality) "to them at that time," supervisor Scott Shoemaker said.
