Middle-school student may wear pro-life t-shirt
School officials and boy's family reach temporary agreement

A federal judge has ruled that a Lewisberry middle-schooler may wear a pro-life t-shirt carrying the message "Abortion is not Healthcare."

Randall Wenger, chief counsel of the Independence Law Center, which defended the student, announced the ruling today.

The West Shore School District had prohibited the student, identified in court records only as E.B., from wearing the t-shirt because administrators feared it might offend other students. They ordered him to wear the shirt inside out.

After the student's father, William Boyer, filed suit on behalf of his son, the student and school reached an agreement that temporarily suspends the "offensive speech" policy, except as it applies to speech promoting illegal activity or indecent speech.

The court gave the two sides until January to reach a permanent agreement.

"We are glad that the school has so quickly come to a reasonable agreement, and we are hopeful that this case will be resolved in a way that encourages other school districts to rework their policies in a way that protects the rights of all students," says Wenger said.

The law center and the Alliance Defense Fund, a national network of Christian attorney, represented the Boyer family.
